Briefly
How to challenge an expert opinion: when a review is needed, what errors to look for, how to prepare objections, questions for the expert, and a motion for a repeat or additional examination.
What can be checked
- Whether the conclusions of the research part correspond
- Whether the expert answered the questions
- Whether the object is described sufficiently
- Whether there is a methodology
- Whether there are contradictions and unfounded conclusions
What a review provides
A review does not automatically cancel the conclusion, but helps prepare objections, questions to the expert, a petition for an additional or repeated examination.
What to prepare for a consultation
- receipt, electronic receipt, or other proof of purchase
- contract, work order, specification, or project
- warranty card, manual, labeling, tags
- photos and videos of defects or damages
- claim to the seller, contractor, or service center
- response from the seller, quality inspection report, or service center report
- flood report, fire documents, or insurance company documents, if applicable
- expert opinion of the other party or case materials if the dispute is already in court
